Definitions of Sexual Harassment

Sexual harassment as defined by the U.S. Equal Employment Opportunity Commission and adapted to the academic environment consists of unwelcome sexual advances, requests for sexual favors, and other verbal or physical conduct or written communications of a sexual nature, regardless of where such conduct might occur.

There are two kinds of sexual harassment: “Quid Pro Quo” and Hostile Environment.

"Quid Pro Quo" harassment occurs when submission to or rejection of unwelcome sexual conduct by an individual is used as a basis for employment or educational decisions affecting that person.

A "hostile environment" may exist where a student or employee is subjected to unwelcome sexual innuendoes, vulgarity, touching, or propositioning even though submission to sexual advances has not been implied as a condition of employment or as a condition affecting educational decisions.

Sexual harassment can take many forms: Verbal, Physical, Written or Visual.

Verbal

  • Sexual innuendoes, comments, and suggestive remarks about clothing, a person's body, or sexual activities
  • Suggestive or insulting sounds
  • Humor and jokes about sex
  • Sexual propositions, invitations, or other pressure for sex
  • Implied or overt threats

Physical

  • Patting, pinching, feeling, or any other intentional and inappropriate touching
  • Making obscene or offensive gestures
  • Attempted or actual kissing or fondling
  • Coerced sexual intercourse
  • Assault (See the University of Arkansas Sexual Assault Policy)

 Written or Visual

  • Pictures or drawings of a sexual nature
  • Sexually derogatory pin-ups, screen savers, posters, cartoons, magazines, or calendars
  • Messages, words, comments, rhymes, or other writing of a sexually derogatory nature
